MedaCube Terms and Conditions

These Terms and Conditions ("Terms") govern your purchase, use, and access to the MedaCube automatic pill dispenser ("MedaCube" or "Product") and related services provided by PharmAdva, LLC ("PharmAdva," "we," "us," or "our"), including the MedaCube app, portal, notifications, and optional cellular connectivity. By purchasing or using the MedaCube, you agree to these Terms. If you do not agree, do not purchase or use the Product.
Please read these Terms carefully. They include important information about your legal rights, remedies, and obligations. For details on data privacy, see our Privacy Policy (www.medacube.com/privacy-policy), which outlines our general privacy practices for non-health information, and our Notice of Privacy Practices (NPP) (portal.pharmadva.com/v2/components/npp.html), which explains how we handle Protected Health Information (PHI) as a HIPAA business associate.
These Terms incorporate by reference our Limited Warranty (www.medacube.com/warranty), Privacy Policy, NPP, Extended Warranty Agreement (www.medacube.com/pages/extended-warranty-agreement), and other policies on www.medacube.com. We may update these Terms; continued use after changes (posted on our website with possible email/portal notice) constitutes acceptance.
1. Return Policy and Money-Back Guarantee
MedaCube units include a 30-day money-back guarantee from delivery date. To return:
- Contact Customer Service at 844-506-9350 or help@pharmadva.com for a Return Merchandise Authorization (RMA).
- Return in original packaging, like-new condition, with all accessories.
- You pay return shipping unless due to our error.
- We issue a full refund (less original shipping) after inspection, typically within 10 business days but can be as long as 30 days.
Post-30 days, returns are not accepted. We may, at our sole discretion, offer to repurchase for up to $200 USD after inspection. The unit must be in working or agreed condition. We may refuse if undisclosed damage exists (e.g., physical, infestation, fire, water). Refused units will be returned at your expense or disposed of if hazardous (with consent where required). Proof of purchase required.
2. Warranty
The MedaCube is warranted against defects in materials and workmanship for one (1) year from purchase date. See our full Limited Warranty at www.medacube.com/warranty for details, exclusions (e.g., misuse, unauthorized repair, normal wear and tear, external causes), remedies (repair, replace, or refund at our discretion), and service process (RMA required). Refer to user manual, www.medacube.com/support, and video tutorials (www.medacube.com/pages/video-tutorials) for proper use.
Optional Extended Warranty: We offer the Comprehensive Warranty for MedaCube 2.0 (also referred to as the all-inclusive 2-year warranty), available for an additional fee. This enhances the standard 1-year limited warranty by providing coverage for an additional year and protection against certain additional damages (such as accidental damage or infestation by insects/vermin, limited to one claim during the term). It may be purchased at any time—often at a lower price if bought with the MedaCube—but for existing/out-of-warranty units, it is subject to verification, serial number submission, and potentially a wait period. The extended warranty is renewable for additional one-year periods at our sole discretion.
Full terms, including coverage details, $250 deductible for accidental damage or infestation claims, exclusions, claim process (prior authorization required), and other conditions, are in the separate Extended Warranty Agreement at www.medacube.com/pages/extended-warranty-agreement. Purchase is available at www.medacube.com/products/2-year-extended-warranty-for-medacube. This optional coverage does not modify the base Limited Warranty unless explicitly stated in the Extended Warranty Agreement.
3. Optional Cellular Service
If Wi-Fi unavailable, optional cellular service is available for an additional monthly fee. Pricing, activation, and hardware costs are at www.medacube.com and subject to change (with notice). We may recommend carrier options at order processing based on location/signal.
Service requires separate agreement; we resell third-party connectivity. Non-payment suspends service, losing portal access, notifications (refills, missed doses, power outages), and updates. Core local dispensing may continue offline. We are not liable for connectivity-related issues or delayed updates.
4. User Responsibilities and FDA Disclaimers
The MedaCube is an FDA-registered Class I medical device (product code NXB: solid medication dispenser/daily activity assist device) intended to assist with scheduled pill dispensing, reminders, and adherence tracking. It is exempt from 510(k) premarket notification but subject to general FDA controls.
Important Disclaimers: The MedaCube is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. It is not a substitute for professional medical advice, diagnosis, treatment, or monitoring by your doctor, pharmacist, or healthcare provider. You remain solely responsible for:
- Accurately filling with correct medications/dosages/schedules.
- Verifying dispensed pills.
- Responding to prompts and refilling timely.
- Ensuring medication safety (consult providers for interactions/adverse reactions).
- Proper use per instructions.
Improper use voids warranties and may deny claims. PharmAdva is not a healthcare provider and provides no medical advice.
You consent to data collection/use per our Privacy Policy and NPP (e.g., usage data, adherence reports).
5. Limitation of Liability
To the fullest extent permitted by law, PharmAdva is not liable for indirect, special, incidental, consequential, or punitive damages from the Product, services, or these Terms (e.g., missed/incorrect doses, reactions, data loss). Total liability is limited to the purchase price paid.
These limitations apply even if advised of risks and regardless of claim basis. Some jurisdictions prohibit certain exclusions, so they may not apply fully. Nothing limits liability for gross negligence, willful misconduct, or non-excludable claims (e.g., product liability for defects causing injury).
6. Privacy and Data Protection
Our Privacy Policy (www.medacube.com/privacy-policy) details general privacy practices for non-PHI data (e.g., contact/order info, usage analytics). For PHI (e.g., adherence reports via portal), our NPP (portal.pharmadva.com/v2/components/npp.html) governs use/disclosure as a HIPAA business associate, including rights to access/amend and complaint processes (contact privacy@medacube.com).
7. Intellectual Property
MedaCube™, PharmAdva®, and related logos/names are trademarks of PharmAdva, LLC. The Product, app, portal, software, content, and materials are protected by U.S. copyright, patent, trade secret, and other laws. You receive a limited, non-exclusive, non-transferable license to use for personal purposes only. No reverse engineering, modification, or commercial use without written consent. All rights reserved.
8. Governing Law and Dispute Resolution
Governed by New York law (no conflict principles). Disputes resolved exclusively in Monroe County, New York state/federal courts.
You agree to binding arbitration under American Arbitration Association rules in Rochester, New York, for any claims (except small claims). You waive class actions, class arbitration, private attorney general actions, and jury trials (to extent permitted). Arbitration is individual only.

9. Miscellaneous
- Entire Agreement: These Terms and the referenced policies are the full agreement.
- Severability: Invalid provisions do not affect others.
- Force Majeure: No liability for uncontrollable events.
- Assignment: We may assign; you may not without consent.
- Age: You must be 18+ and have capacity.
